Project Transfer Q&A

Background

Following our recent communications we are undertaking an operational restructure which means that we will be transferring projects within the Assent group of Approved Inspector companies. This page will be regularly updated with information on the process.

Why are we doing this?

As our business continues to grow we recognise the need to remain competitive and distribute risk across our group structure. We are undertaking an operational reorganisation in order to safeguard all projects by transferring them to other separately licenced Approved Inspectors within the group. This allows us to operate nationally, with a regionalised focus.

What is the process for projects ?

For projects which have not yet started, the process is simplified as all of our businesses within the group already utilise Assent systems and processes. We will simultaneously cancel your existing initial notice and submit a new notice for the work under one of our other Approved Inspector businesses - either Oculus Building Consultancy or LB Building Control.

For projects which are on site we will issue a final certificate for the part completed works, cancel the works yet to complete and issue a new notice from either Oculus Building Consultancy or LB Building Control.

We are able to do this because while Oculus and LB Building Control are part of the Assent Group, they are separate Approved Inspectors, holding separate CICAIR registration and approved inspector licenses.

Do the Building Regulations allow this?

The process we will undertake protects your project and is laid out in Part II of the Building Act 1984 (c.55) (in particular s47, 48, 51, 52 and 53) along with Regulations 17 and 18 of The Building (Approved Inspectors etc) Regulations 2010 (as amended) as follows:

What are the steps?

For projects not started Assent will;

  1. We will simultaneously Issue a new Initial Notice from Oculus Building Consultancy or LB Building Control for the same scheme.
  2. All references, approvals, consultations will remain the same and no new plan check or approvals will be required.
  3. Local Authority building control teams will check the description given in any new Initial Notice and the cancellation notice.
  4. We will provide a clear and unambiguous audit trail of notices and certificates under your existing reference.

For projects which have commenced on site;

  1. Assent will provide a Final Certificate for all the building control work that has been carried out up to the date of transfer.
  2. Simultaneously with the above, we will issue both a Cancellation Notice for the remainder of the building work yet to be carried out and;
  3. Issue a new Initial Notice from Oculus Building Consultancy or LB Building Control for the remainder of the work that is not covered by the Part Final Certificate.
  4. All references, approvals, consultations, and site inspections will remain the same and no new plan check or approvals will be required.
  5. Local Authority building control teams will check the description given in any new Initial Notice to ensure it doesn’t cover work already the subject of a Part Final Certificate.
  6. We will provide a clear and unambiguous audit trail of notices and certificates under your existing reference.

Should you wish, you can reject the opportunity to transfer your project, however there will likely be a financial disincentive in appointing a new building control body, compared with continuing with a provider within the Assent Group (Oculus Building Consultancy or LB Building Control).

What is the impact of the project transfer

This transfer will not affect your project in any way. We are regionalising the Assent group to improve efficiency and management utilising the Approved Inspector licences held by Assent . The transfer of the project mentioned in the previous communications email simply means it is to be transferred/novated to another part of Assent. You can continue to call our office on the numbers below as your project remains with us.

Will my existing approvals be affected?

The existing application sets the date of submission. The transfer of the project is a novation from one of our group licences to another. It does not affect the approvals in place or require any changes in regulations since the date of submission to be applied. If we are acting as a warranty provider inspections and reporting carry on as normal between ourselves and the warranty provider.

Will I still deal with the same people?

Yes you will still deal with your existing surveyor and inspections can be booked in the same way.

What happens if my project finishes before May?

We do not need to transfer this project. Our surveyors will manage this process.

If I want to proceed do I need to confirm?

You do not need to confirm if you wish to proceed. The process is opt out and will take place automatically on or after 15 days from the date you received the project transfer request.

What happens if I do not want to transfer?

While the process is simple and safeguards any projects you can still decide not go through this process for your projects. Please contact the office within 12 days from your email to confirm if this is the case.

In the event you let us know that you do not wish to proceed we can work with you to issue certification for the works completed and then cancel the application in relation to the outstanding works allowing you to select another building control provider.

Another Approved Inspector can submit a notice for the remaining works using the BCA transfer protocol (link provided) and its strict timescales or you can conclude the works with the Local Authority in your area.

Each of these options would be subject to further fees which Assent are not liable, and the new building control body may have a different interpretation to the regulations which means you could incur further costs for your project which Assent hold no liability for.

All outstanding invoices held by Assent for works undertaken must be paid.
